12. Assumption of Risk & Liability Waiver
By boarding the vessel and participating in any activities offered by Suncoast Marine Tours,
all passengers acknowledge and agree to the following:
- Boating and marine activities involve inherent risks, including but not limited to:
- Sudden boat movements caused by waves or wakes
- Slips, trips, and falls on deck
- Contact with fishing equipment, hooks, rods, coolers, or gear
- Injury caused by sharp or moving equipment
- Unexpected weather or sea conditions
- Entering or exiting the vessel
- Swimming, snorkeling, or entering the water
- Passengers accept full responsibility for their own safety and actions while on board.
- Passengers agree to hold Suncoast Marine Tours, the captain, crew, and vessel owner harmless
from any injury, loss, or damage that may occur as a result of normal vessel operation or unforeseen sea conditions. - Passengers understand that the vessel may experience sudden movements, impacts, or drops due to waves,
and they must hold on, maintain balance, use handrails, and follow all instructions from the captain. - Any injury resulting from:
- wave impact
- sudden acceleration or deceleration
- falls on wet surfaces
- unstable footing
- passenger negligence
is the full responsibility of the passenger.
- Passengers certify they are physically able to participate in marine activities and do not have conditions that may increase risk.
- By remaining on the vessel after boarding, passengers explicitly waive any right to claim or pursue legal action for injuries
or damages associated with the normal risks of boating.
13. Release of Liability
By boarding the vessel and participating in any activities operated by Suncoast Marine Tours (“the Company”),
all passengers expressly acknowledge, understand, and agree that boating, fishing, snorkeling, swimming,
and marine activities involve inherent and unavoidable risks, including but not limited to:
- Sudden vessel movements caused by waves, wakes, or weather
- Slips, trips, and falls due to wet or unstable surfaces
- Impact with seats, rails, consoles, doors, or other passengers
- Injuries from fishing equipment, hooks, knives, weights, rods, and marine life
- Boarding and disembarking the vessel
- Motion sickness or heat-related illness
- Equipment malfunction despite regular maintenance
Passengers voluntarily assume all such risks, whether foreseen or unforeseen.
Therefore, passengers release and forever discharge Suncoast Marine Tours, the vessel owners, the captain, crew,
employees, agents, and contractors from any and all liability, claims, demands, or causes of action arising from injuries,
accidents, damages, or losses incurred during participation in any activity or travel on the vessel.
This release applies even if the injury is caused partially or entirely by the ordinary negligence of the Company or crew.
14. Cancellation & Weather Policy (Florida)
14.1 Customer Cancellations
- Cancellations more than 24 hours before departure → Full refund.
- Cancellations less than 24 hours before departure → No refund.
- No-show at departure time → No refund.
14.2 Weather Cancellations
The captain has sole authority to cancel or reschedule due to:
- Lightning
- Severe winds or storms
- Unsafe seas
- Mechanical issues
- Coast Guard weather advisories
If the captain cancels the trip before departure, customers may choose:
- Full refund, or
- Rescheduling to another available date
If the tour is shortened or altered after departure for safety, no refund is issued,
because safety decisions are mandatory under maritime law.
14.3 Mechanical Issues
If the vessel cannot depart due to mechanical problems, the customer receives a full refund or may reschedule.
14.4 Late Arrivals
Tours depart exactly on schedule. Late arrivals may not be accommodated, and no refund is issued.
